Terms of Service

These terms govern your use of Departly, a business-operations platform operated by Devforest AI (SMC) Private Limited (“Departly”, “we”, “us”). By creating an account or using the service you agree to them on behalf of yourself and the business you represent (“you”, the “Customer”).
1. The service
Departly provides AI agents that help run business operations: capturing and qualifying leads, drafting outreach and replies, managing invoices and reminders, and a voice agent that answers calls, books appointments and hands callers to your team. Departly is currently offered as a private pilot, and features may change as we improve them.
2. Your account
You are responsible for keeping your login secure and for the actions of everyone who uses your account. Tell us promptly at [email protected] if you suspect unauthorised use.
3. Your responsibilities
- You configure what the agents may do, including approved business information, prices they may state, and actions that need your approval.
- You are responsible for the accuracy of the business information you provide and for decisions you approve.
- You must have a lawful basis to contact the people you ask Departly to contact, and you must honour their requests to stop.
- Where the law requires it, you must tell callers that calls are handled by an AI assistant and may be transcribed or recorded. Departly’s voice agent announces this at the start of each call.
- You must not use Departly for unlawful, deceptive, harassing or spam communications, or to collect payment card details by voice.
4. AI outputs
The agents use AI models that can make mistakes. Departly is designed to record every action, to ask for confirmation before consequential steps, and to report failures rather than claim success, but you remain responsible for reviewing important outcomes. AI output is not legal, medical, tax or financial advice.
5. Connected services
You may connect third-party services such as Google Calendar, Gmail, telephone providers, email providers and payment providers. Your use of those services is governed by their own terms. Departly accesses them only to perform the actions you enable, and you can disconnect them at any time.
6. Your data
You own the data you and your customers put into Departly. You grant us permission to process it only to provide and secure the service, as described in our Privacy Policy. We do not sell it.
7. Fees
Pilot pricing is agreed with you in writing. Usage-based costs, such as AI model usage and phone minutes, are shown in the Charges view of the product. We will give you notice before any change to fees applies to you.
8. Availability
We work to keep Departly available and secure, but the service is provided “as is” during the pilot, without guarantees of uninterrupted operation. We may suspend features that put callers, you or the service at risk.
9. Liability
To the extent permitted by law, we are not liable for indirect or consequential losses, and our total liability for any claim is limited to the fees you paid us in the three months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.
10. Ending the service
You may stop using Departly at any time and ask us to delete your data. We may end or suspend access if these terms are breached. On termination we delete Customer data within a reasonable period, except where the law requires us to keep it.
